VISITOR TERMS OF USE
Terms for transient boaters and temporary berth users

Operator: Docky Holding LLC and the applicable Docky affiliated operating entity, including DOCKY USA LLC and, where applicable, DOCKY FRANCE SASU.
1. Scope
These Visitor Terms supplement the Docky General Terms whenever you request, reserve, pay for or temporarily occupy a berth through Docky.
2. Docky's Role and Provider Type
Docky provides search, matching, documentation, communications and payment technology. A berth may be Marina-Managed or a lawful Direct Listing. Docky does not itself grant marina access and is not the vessel's operator, insurer, surveyor or bailee.
3. Marina-Managed Berths
For a Marina-Managed Berth, the Marina/Port Operator retains final authority over admission, vessel eligibility, berth assignment, documentation, insurance, safety, security, arrival/departure and local rules. A Docky confirmation remains subject to any final marina clearance.
4. Direct Listings
For a Direct Listing, the listing provider represents that it has the legal and contractual authority to offer the berth. You remain responsible for complying with any applicable marina, association, lease, concession, property, port or local rules disclosed for the listing. Docky does not independently verify every underlying property or contractual right.
5. Eligibility and Vessel Information
You must be legally authorized to arrange berthing for the vessel and provide accurate registration, dimensions, draft, type, insurance, arrival/departure and other required documents. Material discrepancies may result in refusal, reassignment, cancellation or additional charges.
6. Insurance
Maintain valid vessel insurance meeting applicable legal and provider requirements. Docky does not provide or guarantee insurance and document checks do not guarantee coverage.
7. Arrival, Occupancy and Departure
Follow applicable arrival, check-in, identification, berth-assignment, mooring, utility and check-out instructions. Occupy only the berth authorized for your Booking. Overstay may result in additional lawful charges or operational action.
8. Conduct, Crew and Guests
You are responsible for your crew, passengers, contractors, invitees, pets and equipment to the extent permitted by law. Follow safety, environmental, speed/no-wake, noise, waste, fueling, security and other applicable rules.
9. Fees, Taxes and Deposits
Pay all amounts disclosed for the Booking, which may include berth charges, Docky Platform Fees, taxes, utilities, deposits, cancellation/no-show charges, overstay charges and other validly disclosed amounts. Payment may be processed by Stripe or another provider.
10. Cancellations and Refunds
The policy displayed for the Booking applies together with mandatory law and applicable marina/provider terms. Docky may facilitate a refund, credit or alternative but does not guarantee a substitute berth or a refund controlled by another party.
11. EU Consumer Timing
Where mandatory European consumer law applies, any statutory right of withdrawal or exception to that right is governed by applicable law and the nature/date of the booked service. Booking-specific disclosures shown before purchase form part of the transaction terms.
12. Damage, Incidents and Pollution
You are responsible for safe navigation, docking, mooring and operation. Promptly report collision, damage, injury, fire, pollution, theft or other material incidents to the relevant operator/provider and, where appropriate, emergency services, insurers and Docky.
13. No Permanent Property Right
A Booking grants only the temporary occupancy right lawfully provided for that Booking. It does not create ownership, a permanent tenancy, assignment of an Annual Berth Holder's marina contract or any other permanent property right.
14. Navigation, Weather and Safety
You alone decide whether it is safe and lawful to navigate, enter, remain or depart. Docky maps, location, weather, depth or route information are informational and are not a substitute for official charts, notices, professional judgment or marina instructions.
15. Refusal, Suspension and Reassignment
Docky, the Marina/Port Operator or lawful provider may refuse or suspend the workflow for invalid documents, non-payment, unsafe conduct, inaccurate information, fraud, sanctions/legal issues or violation of applicable rules.
16. Prohibited Conduct
No false identity, vessel, registration, insurance, payment or authority information; unsafe or unlawful operation; harassment; prohibited cargo/activity; intentional fee circumvention; or unauthorized access to restricted areas, utilities, berths or vessels.
17. Liability, Data and Disputes
The General Terms' disclaimers, liability, indemnification, privacy and dispute provisions apply. Docky may transmit necessary identity, vessel, insurance, dates and Booking information to the relevant Marina/Port Operator, lawful provider and service providers as described in the Privacy Policy.
